By accessing or using GuideTheDriver ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

GuideTheDriver is an online marketplace that connects vehicle buyers and sellers in the United Kingdom. We provide a platform for listing vehicles, searching for vehicles, making reservations, and facilitating transactions.

3. User Accounts

• You must be at least 18 years old to create an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account
• You must notify us immediately of any unauthorised use of your account

4. Vehicle Listings

For Sellers:

• You must own or have legal authority to sell any vehicle you list
• All information provided must be accurate and not misleading
• You must disclose all known defects, issues, or problems with the vehicle
• You are responsible for ensuring the vehicle meets all legal requirements for sale
• You must not list stolen vehicles or vehicles with outstanding finance (unless disclosed)

For Buyers:

• You are responsible for verifying vehicle information before purchase
• We recommend independent inspections and history checks
• Transactions are between buyers and sellers; we are a facilitator only

5. Reservations and Payments

• Reservations place a temporary hold on a vehicle for a specified period
• Reservation fees are processed through our secure payment provider (Stripe)
• Reservation fees may be refundable or non-refundable as specified at the time of booking
• Final vehicle purchases are completed directly between buyer and seller

6. Prohibited Activities

You may not:

• Use the Service for any unlawful purpose
• Post false, misleading, or fraudulent content
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorised access to our systems
• Use automated scripts or bots without permission
• Harvest or collect user information
• Engage in any activity that could harm our reputation

7. Intellectual Property

The Service and its original content, features, and functionality are owned by GuideTheDriver and are protected by copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

We do not verify vehicle listings and are not responsible for the accuracy of information provided by users. Buyers should conduct their own due diligence.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUIDETHEDRIVER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless GuideTheDriver and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our website or sending an email. Continued use of the Service after changes constitutes acceptance of the new Terms.
